When is a pirate not a pirate?

To answer the second question first, we would do well to remember the words of noted African-American author Toni Morrison: "….definitions belong … to the definers - not the defined." Calling people who use copyrighted works without the permission of their owners "pirates" is a crude, but often effective, rhetorical device to cast such people as simply the contemporary version of the robbers and thieves who raided ships at sea in the days of sail and made off with chests of gold and other booty.
